The US Supreme Court will give its verdict today i.e. on Wednesday regarding Trump’s right to impose tariffs. The decision may come by 8 pm Indian time tonight. Trump has expressed concern about this.
Trump had said on Monday, ‘If the court limits his authority to impose tariffs, America may have to return billions of dollars earned from tariffs.’
Actually, the US Supreme Court is going to give its verdict on the case related to Trump’s April 2025 global tariff. In this it will be seen whether the President has the right to impose such huge tariffs under the International Emergency Economic Powers Act (IEEPA).
This law was made in 1977 for national emergency situations, which in certain circumstances gives the President the right to ban or control international transactions during national emergency.
Trump claims that these tariffs have generated more than $600 billion in revenue for the US, and that they strengthen national security. He also accused the media of influencing the court.
Trump had imposed tariffs citing trade deficit as an emergency.
Citing the IEEPA Act of 1977, Trump declared America’s trade deficit a national emergency and imposed tariffs on most countries.
In November last year, the Supreme Court had raised questions on the legal basis of imposing tariffs by the Trump government. During that time the judges had asked whether the President has the right to impose such global tariffs. The court held a long hearing in this matter.
The court said that Trump can impose 15% tariff for 150 days, but a solid reason is required for this. The judgment said that the word ‘tariff’ is not mentioned anywhere in the IEEPA, nor does it place any clear limits on the powers of the President.
12 states’ lawsuit against Trump
Trump had announced these tariffs in April last year. Many small businessmen and 12 states of America have filed a lawsuit against these tariffs. He says that the President went beyond his limits and imposed new tariffs on imported goods.
The states of Arizona, Colorado, Connecticut, Delaware, Illinois, Maine, Minnesota, Nevada, New Mexico, New York, Oregon and Vermont, along with small businessmen, have filed this case against the Trump government.
The Trump government had argued in the court that if the tariffs are removed, billions of dollars may have to be recovered. This will be a big blow to the American treasury.
Lower courts declared the tariffs illegal
Lower courts (the Court of International Trade and the Federal Circuit Court) ruled the tariffs unlawful. He believes that IEEPA does not provide such broad power to impose tariffs.
The Supreme Court heard oral arguments in November 2025, where the justices expressed skepticism about the arguments presented by Trump. Despite the Court’s 6–3 majority, the Justices asked whether the President could impose tariffs on such a large scale without Congress’s approval, since tariffs are a form of tax and are the responsibility of Parliament.
The verdict was expected on January 9, 2026, but it was postponed. Some experts say this delay could work in favor of the Trump administration, as it gives the court time to consider further.

Trump has imposed 50% tariff on India
America has imposed a total tariff of 50% on India. Out of this, 25% tariff has been imposed due to purchase of Russian oil. Due to this, India is facing difficulties in selling its goods in America, which is affecting India’s exports.
India wants the total 50% tariff imposed on it to be reduced to 15% and the extra 25% penalty imposed on buying crude oil from Russia should be completely eliminated. It is expected that a concrete decision will be taken in the new year from the ongoing talks between the two countries.
Know the International Emergency Economic Powers Act (IEEPA)…
- What is it and when was it made? It is a US federal law, signed by President Jimmy Carter on December 28, 1977. The Treachery with the Enemy Act (TWEA) of 1917 was created to limit the previously unlimited powers.
- Objective to deal with foreign threat: Gives the President the power to deal with threats coming from abroad and to control international economic transactions, but it is monitored by the Parliament.
- Powers given to the President: After declaring an emergency, the President can impose economic sanctions on international trade, payments, freeze assets, restrict imports and exports, and so on. The threat must be completely foreign. It is necessary to consult the Parliament and submit report every 6 months.
- Used to impose tariffs for the first time: Never used to impose tariffs before 1977. Trump used it for tariffs in 2025, which is under challenge in the Supreme Court on whether this law allows imposing tariffs (taxes).
