The bench of Justice BV Nagarathna and Justice N Kotishwar Singh heard the decision of the Madhya Pradesh High Court.
The Supreme Court said that judges should live like monks and work like horses. They should avoid using social media. No opinion should be expressed regarding decisions.
On Thursday, the bench of Justice BV Nagarathna and Justice N Kotishwar Singh made these oral remarks. The bench was hearing the case of suspension of 6 women judges of Madhya Pradesh High Court in June 2023.
The bench said, ‘There is no place for showmanship in the judiciary. Judicial officers should not go on Facebook. They should not comment on the judgments, because if the judgment is referred to tomorrow, the judge would have already expressed his opinion in some way or the other.
The bench said-
Facebook is an open platform. You (judges) have to live like a monk, work like a horse. Judicial officers have to sacrifice a lot.
In May 2023, Madhya Pradesh government dismissed 6 women judges.
On the recommendation of the High Court, the Law and Legislative Affairs Department of Madhya Pradesh had issued an order on May 23, 2023, terminating the services of 6 women judges. This order was given on the basis of the decision of the Administrative Committee and Full Court meeting of the High Court.
The reason given for termination of services was that the performance of these women judges was poor during the probation period. The gazette notification of the state government order in this regard was issued on June 9, 2023. Later, the Supreme Court took suo motu cognizance of this matter in January 2024.
The names of 6 women judges whose services were terminated by the Madhya Pradesh government included Sarita Chaudhary, Rachna Atulkar Joshi, Priya Sharma, Sonakshi Joshi, Aditi Kumar Sharma and Jyoti Barkhede.
In September, the Supreme Court had given orders to reinstate the jobs of all the judges except Aditi Kumar Sharma and Sarita Chaudhary. It was said that the order would be given after looking into the cases of Aditi Kumar Sharma and Sarita Chaudhary separately.
December 4: Court had said- If men had experienced menstruation then they would have understood the situation.
The bench had heard the same case on December 4. The counsel for the Madhya Pradesh government had told the bench that the woman judge was not able to dispose of the case during the probation period. His performance was bad. There are similar rules for female judges as for male judges.
On this the bench had said – If only he (male judge) had menstruation, only then he would have been able to understand. If women are suffering physically and mentally then don’t call them slow workers and send them home.
Aditi Kumar Sharma was recruited in 2018
Aditi Kumar Sharma was recruited into Madhya Pradesh Judicial Service in the year 2018. According to the High Court report, his performance during the probation period in the year 2019-20 was very good. Later his ratings kept falling. His average deteriorated. They had around 1500 pending cases in 2022. The rate given to dispose of them was less than Rs 200. Later, Aditi Sharma told the High Court that she had a miscarriage and that her brother was suffering from cancer. He said that he was dismissed without getting proper information. This is wrong.
