The Supreme Court reserved its decision on the bail of Partha Chatterjee.
Hearing was held in the Supreme Court on Wednesday in the ED money laundering case related to former West Bengal minister Partha Chatterjee. Chatterjee’s lawyer Mukul Rohatgi sought bail from the bench of Justice Surya Kant and Justice Ujjal Bhuiyan.
Arguing Mukul, he said – Except Chatterjee, all the accused in this case have been granted bail, even a week ago one accused was granted bail. Chatterjee has been in jail for 2.5 years.
On this the bench said – Partha Chatterjee should be a little ashamed of claiming to be like the other accused, because all of them are accused because of this. Not everyone is a minister. The first thing is that you (Partha Chatterjee) are a corrupt person. Crores of rupees have been recovered from your house. What message do you want to give to the society? Can a corrupt person get bail in this way?
The bench said that you (Partha Chatterjee) cannot demand treatment like others. One can question the delay in investigation and the role of the other party, but not the merits of the case. After the hearing, the bench reserved its decision on Parth’s bail.
Actually, ED had arrested Partha Chatterjee on 25 April 2023 in a money laundering case related to the West Bengal School Service Commission (WBSSC) teacher recruitment scam. On July 22, ED had recovered Rs 20 crore cash in a raid from 18 locations of Parth and his close friend Arpita. Parth is in jail since his arrest.

Rohatgi- Chatterjee has been in jail for a long time in this case. He should be granted bail like other accused.
bench- If corrupt people can get bail in this case, what message will it send to the society?
SV Raju- Even if Chatterjee gets bail in this case, he will not come out of jail, because CBI cases are also pending against him.
Rohatgi– It seems that he (Raju) is taking pleasure in Parth’s trouble. Whatever happens in other matters is in my view. I have to start somewhere. What kind of argument are they making? Parth has been in jail for 2.5 years.
Rohatgi- The money was recovered not from Parth’s premises but from the premises of a company.
bench- Chatterjee had control of the company. Many properties were purchased in the joint name of him and Arpita Mukherjee. After Parth became minister, dummies were placed. First you (Parth) controlled yourself. The matter is of 2022. You (Parth) were a minister, obviously you (Parth) did not order an inquiry against yourself. The investigation started after the intervention of the court. It is alleged that Rs 28 crore has been recovered. Obviously such a huge amount would not have been kept at home.
bench- The court needs to examine whether the release of Partha Chatterjee will affect the investigation and conditions of the case, as Partha Chatterjee cannot be kept in jail indefinitely.
Rohatgi- Parth is 70 years old, he fainted during the court proceedings. Some conditions may be imposed such as he will not enter the area, will stay somewhere else.
After hearing the arguments of both the sides, the bench reserved its order.
