- New Online Gaming Rules Come Into Effect Today; Gaming Certificates To Remain Valid For Up To 10 Years; Non Money Games Now Exempt From Registration

A big change is going to happen in the online gaming industry in the country from today. The government has implemented the Promotion and Regulation of Online Gaming Rules 2026 from Friday, May 1, 2026.
The main objective of these new rules is to prevent financial and social harm caused by online money gaming and to make India a global gaming hub.
Complete ban on online money games, will not be able to advertise also
Under the new rules, all types of online money games have been completely banned. This includes both chance-based and skill-based games in which money is wagered.
Now advertising or promoting these games will also be illegal. Banks and payment gateways have been instructed not to process transactions on such platforms.
Heavy fine and up to 5 years jail for breaking rules
- The government has made provisions for strict punishment for those who violate the rules.
- Offering online money games can lead to a jail term of up to 3 years or a fine of up to Rs 1 crore.
- In case of repeat offence, the jail term may increase up to 5 years and the fine may be up to Rs 2 crore.
- There is a provision of 2 years in jail or a fine of up to Rs 50 lakh for advertising these games.
45 crore people affected, loss of more than 20 thousand crores
- The online gaming market in India has grown rapidly and in 2024 it was worth Rs 232 billion i.e. Rs 23,200 crore.
- According to the data, about 45 crore people of the country have been affected by money gaming platforms, in which people have suffered a loss of more than Rs 20,000 crore.
- Keeping this in view, the government has decided to promote e-sports and social games (entertainment games) and eliminate money games.
Now Online Gaming Authority of India will keep an eye
Online Gaming Authority of India (OGAI) has been formed to effectively enforce the rules.
- Digital Office: The Online Gaming Authority of India, which will have its office in Delhi, is a digital-first regulator.
- Decision Making Process: This authority will decide within 90 days whether a game falls in the category of ‘money game’ or is protected as ‘e-sports’.
- registration: Now digital registration certificate for up to 10 years will be given for e-sports. Earlier the validity of the certificate was 5 years.
- Grievance redressal: There will be a two-tier system for user complaints. If the company does not resolve, the user will be able to appeal to the authority.
Age gating and parental controls to protect youth
To make the digital environment safe, companies will now have to provide many safety features. These include age verification, time restrictions, and parental control tools. This will help in protecting the youth from addiction and mental stress.
Classification of games will be done in three ways
The authority has decided on three ways to decide which category the games will be placed in…
- Suo moto: The authority itself can review a game and classify it.
- E-Sports Bodies: Institutions related to e-sports can apply themselves.
- Central government: The government can notify specific social games.
A time limit of 90 days has been set to complete the process of classification of any game. Now there will be no need for mandatory determination for every game.
Two-tier system for user safety
- The government has mandated a two-tier grievance redressal system for the safety of gamers and to resolve their complaints.
- Apart from this, gaming platforms will have to maintain data retention and submit compliance reports from time to time.
- The Home Ministry has also been made a part of this authority, so that action like blocking games that violate the rules can be taken.
Changes in promotion and refund rules
Provisions related to game promotion have been removed from the new guidelines. Now different ministries will be able to design promotion schemes according to their plans. The concept of material change has also been removed, so that disputes do not arise between companies and the government. Rules related to refund have also been removed, because the government believes that this problem has already been resolved.
The way to the future, digital economy and new jobs
The government believes that these rules will strengthen India’s creative economy. The growth of e-sports and safe social games will create new investment and employment opportunities in the sectors of design, technology and content creation. By 2027, this sector is expected to reach Rs 316 billion i.e. Rs 31,600 crore.
Opinion taken from 2,500 stakeholders
Before finalizing these rules, the government had taken suggestions from about 2,500 people, including industry bodies, law-knowledgeable firms and academic experts.
Stakeholders had suggested clarifying the definition of gaming and improving the authority structure, which have been included in the new notification.
What is Online Gaming Authority of India?
The Online Gaming Authority of India (OGAI) will be a six-member team. Apart from the IT Ministry, representatives of the Home Ministry will also participate in it.
Its main function is to monitor the games running in India, decide their classification and ensure the privacy and security of the users.
What is e-sports?
It is a competitive digital sport that requires teamwork and skill. It can now get recognition under the National Sports Governance Act.
What to do if a platform asks for money?
Report such platforms immediately to the ‘Online Gaming Authority’ or Cyber Cell, because games with online money transactions are now banned in India.
