The new Chief Justice of India (CJI) Justice Surya Kant made a major change in the procedure of the Supreme Court as soon as he took charge on Monday. He has stopped oral mentioning for urgent listing of cases.
Before CJI Surya Kant, former CJI Sanjeev Khanna had also stopped the practice of oral mention. His successor was former CJI B.R. Gavai had started it again, which has now been limited again by CJI Surya Kant.

Now oral mentioning will not be accepted for urgent listing of cases. Only written mentioning slip will be valid. Oral mention will be heard only in exceptional circumstances, such as death penalty or personal liberty cases.
Actually, Justice Surya Kant took oath as the 53rd Chief Justice (CJI) of the country on 24 November. President Draupadi Murmu administered the oath of office to him in a ceremony held at Rashtrapati Bhavan. After this he touched the feet of the sister and elder brother present there. His family members also participated in this program.
The tenure of current CJI BR Gavai ended on Sunday 23 November. After him, Justice Surya Kant will now take over this responsibility. Justice Surya Kant will retire on 9 February 2027 and his tenure will be about 14 months.
Other important proceedings of CJI Surya Kant’s first day
- He encouraged a junior lawyer and said – If you argue, we can also give a little discount.
- Notice issued on status of NIA investigation in petition by families of victims of alleged fake encounters in Manipur.
- In an appeal filed against the decision of Allahabad High Court, in which there was a demand to remove the husband of a judge from the post of government lawyer. CJI said- Please do not target any person. The petition was later withdrawn.
Hearing of 17 cases on the first day after the oath of CJI
On his first day as CJI, Justice Surya Kant heard 17 cases in proceedings of about two hours. After this he appointed Justice Joymalya Bagchi and Justice Atul S. Presided over the bench of 3 judges in Court No. 1 along with Chandurkar. As soon as the proceedings started, the first decision was given on the petition of Himachal Pradesh government.

Justice Surya Kant took oath as the 53rd Chief Justice (CJI) of the country on Monday. After the oath, CJI Surya Kant met PM Modi and others. He hugged former CJI BR Gavai. In this ceremony, Chief Justices and Supreme Court judges of seven countries including Brazil also reached Rashtrapati Bhavan.
For the first time in the history of the Indian judiciary, such a large international judicial delegation was present at the swearing-in of a CJI. Chief Justices of Bhutan, Kenya, Malaysia, Mauritius, Nepal and Sri Lanka and their family members also attended the ceremony.
During this time, former CJI Gavai set a new example. After the swearing-in ceremony, he left his official vehicle at Rashtrapati Bhavan itself for his successor Justice Surya Kant.

CJI Surya Kant’s tenure will be for 14 months
CJI Surya Kant will be the head of the Supreme Court Collegium.
CJI Surya Kant began the official proceedings in Court Room No. 1 along with bench justices Joymalya Bagchi and Justice Atul S Chandurkar. Justice Surya Kant will now also be the head of the five-member Supreme Court Collegium.
The five-member collegium that selects Supreme Court judges and decides on transfer of High Court judges will now include CJI Kant and Justices Vikram Nath, Justice BV Nagarathna, Justice JK Maheshwari and Justice MM Sundaresh.
The three-member collegium, which selects High Court judges, will have the CJI and Justice Vikram Nath and Justice BV Nagarathna as members. Even though Justice Kant has a tenure of about 14 months as CJI, there will be only one change in the collegium when Justice Maheshwari retires on June 28, 2026.
Justice PS Narasimha will become a member of the collegium. After the retirement of CJI Kant, Justice JB Pardiwala will join the collegium.
Saw the city for the first time after 10th
Justice Surya Kant’s father Madan Mohan Shastri was a Sanskrit teacher and famous litterateur. Mother Shashi Devi was a housewife. Elder brother Rishikant is a retired teacher, second brother Shivkant is a doctor and third brother Devkant is retired from ITI. Sister Kamla Devi is the eldest. Justice Surya Kant is the youngest. Elder brother Rishikant told, Suryakant studied till 10th class in village Petwad. After this I saw the city for the first time.
Surya Kant’s elder brother Dev Kant told that Justice Surya Kant’s wife is Savita Surya Kant and she has retired from the post of Principal in the college. She has been a professor of English. They have 2 daughters- Mugdha and Kanupriya. Both daughters are studying.
Brother Rishikant told, when there was talk of Suryakant’s marriage, he had said that he will not take even a spoon in dowry. Married to Savita Sharma of Jind in 1987.

Memorable decisions of Justice Surya Kant
Supreme Court Justice Surya Kant has been a part of many constitutional benches. During his tenure, he was involved in more than 1000 decisions covering constitutional, human rights and administrative law matters. His major decisions also include upholding the 2023 decision to abrogate Article 370.
- He was part of the full bench of the Punjab and Haryana High Court which in 2017 had ordered a complete clean-up of Dera Sacha Sauda following the jail violence involving Dera chief Gurmeet Ram Rahim in rape cases.
- Justice Surya Kant was part of the bench that kept the colonial era sedition law in abeyance. It was also directed that no new FIR should be registered under this till the review by the government.
- Justice Surya Kant is also credited for giving instructions to reserve one-third seats for women in all bar associations, including the Supreme Court Bar Association.
- Justice Surya Kant was part of the seven-judge bench that had struck down the 1967 Aligarh Muslim University decision. The way was opened for reconsideration of the minority status of the university institution.
- He was part of the bench hearing the Pegasus spyware case, which formed a panel of cyber experts to investigate allegations of illegal surveillance. He had also said that there cannot be free rein under the guise of national security.
Also heard Bihar SIR case
Justice Surya Kant also heard the case related to SIR in Bihar. In an order highlighting transparency in the election process, Justice Surya Kant had directed the Election Commission to make public the details of 65 lakh names that were excluded from the draft voter list in Bihar after special intensive revision.
Every year we go to honor the toppers of schools in Petwad.
Rishikant told, ‘When one brother became a doctor, father wanted Suryakant to become an engineer, but he studied law. Was quick in studying. Suryakant is still associated with the village. They come every year to honor the toppers of both the schools of the village. There is a pond in the village named after the ancestors. Definitely go there. Whenever Bathua comes, millet roti and curry are prepared.
Petwad, with a population of ten thousand, 50 km away from Hisar, has a glorious history. A pride plaque has been installed in the village. On one inscription are written the names of 5 freedom fighters of the village, on the other two martyred soldiers and on the third are the names of 26 people who reached high positions. These include IAS, IPS, scientists, doctors etc. The name of Justice Surya Kant is at the top in this. Justice Suryakant lives in the village with elder brother Rishikant and sister-in-law Rajbala.
