Chief Justice of India (CJI) Surya Kant on Monday said that it is very important that family courts eliminate psychological fear from the minds of children, and for this some changes should be made in the traditional functioning of the court. He asked whether these black robes should be there in the family court?
The CJI said that when we are creating a new thinking and concept for the Family Court, will it not create any psychological fear in the mind of the child? He suggested that the presiding judge and lawyers in the family court should not come in uniform. Justice Surya Kant said these things in the program of laying the foundation stone of a family court in Rohini, Delhi.
He said that for all of you in the family court, our presiding officer will not sit in court attire. Bar members will also not come in black and white robes. He said that even police officers will not come in police uniform, because this whole environment creates fear in the minds of children, especially when they are the biggest victims of any system.

- Not everyone wants to come to court. When we talk about reforms and when we look at the concept of Family Court as a forum to resolve disputes, it is not like civil property disputes.
- Its purpose is to improve, consider and correct human relationships. Can’t we call these ‘Family Solution Centres’?
- Unlike most cases and disputes in the Family Court compared to other courts, these are not between distant parties or inanimate entities. These issues arise from within families.
- Between individuals who were once partners in a shared life, they may continue to share mutual responsibilities as parents, caregivers, or members of the same household.
- Therefore, the disputes that come before the Family Court have huge emotional, social and financial consequences that go far beyond the immediate legal dispute.
Delhi CM, other Supreme Court judges also participate in the program
Speaking at the event, Supreme Court Justice Manmohan said that in Delhi, the continuous challenges that the district judiciary faces are of three types. The first is budget, the second is staff and the third is space. He said space meant court rooms, as well as living arrangements (residential accommodation).
Delhi Chief Minister Rekha Gupta and Delhi High Court Chief Justice D.K. Upadhyay also expressed his views in this program.
