- Supreme Court Grants Divorce To Estranged Software Engineer Couple, Upholds Madras High Court Verdict

The Supreme Court said that the marriage relationship is based on mutual trust, togetherness and shared experiences. If these things do not happen for a long time, the marriage remains only on paper.
The court further said that the purpose of marriage is the happiness and respect of both, and not tension and dispute.
The court made this comment while upholding the decision of the Madras High Court, which had ordered the divorce of a software engineer couple who had been living separately for 20 years.
The Supreme Court granted the divorce and ordered a compensation of Rs 50 lakh to the wife. Along with this, he was also asked to give Rs 50 lakh for his daughter’s education and future expenses. The husband will have to pay this amount within four months.
The court said;-
When a marriage has become a source of sadness and stress for both parties, it is not right to force it. In this case, the husband and wife should be given a chance to separate and start their life afresh.

When wife did not return from her parents’ house for 20 years, husband asked for divorce.
The couple were married on 30 June 2002. In 2003, a daughter was born to them. After the birth of the daughter, the wife went to her maternal home, but did not return. Since then the husband and wife are living separately.
The husband moved court for divorce saying the wife made false allegations against him and his family and lodged complaints, causing mental and emotional distress to him. The wife had opposed this divorce, but the court rejected her arguments.
