The Supreme Court will hear the Kolkata RG Kar Medical College rape-murder case on Tuesday (September 17). In the last hearing on September 9, a bench of CJI DY Chandrachud, Justice JB Pardiwala and Manoj Mishra heard three issues – CBI investigation report, doctors’ strike and facilities for CISF jawans.
Many things came to light in the status report of CBI. The court said that there was a delay of 14 hours in the FIR. Some important documents are also missing. In such a situation, the matter seems fishy. The court ordered the state government to present the missing documents in the court.
Regarding the strike, the court had asked the doctors to return to work immediately. The CJI said, ‘If the doctors do not return to duty by 5 pm on September 10, then the state government cannot be stopped from taking action against them. The profession of doctors is to serve the patients.’
On the facilities of CISF jawans, the court had ordered the state’s Home Secretary to provide houses to all the jawans to live in. These jawans have come to protect the hospital. They should also be given additional security equipment.
Despite the court order, the junior doctors did not return to work. The doctors continued their protest saying that the Mamata government is not fulfilling their demands. First issue- Status report of CBI investigation on rape-murder of trainee doctor
CJI: What is the distance between RG Kar Medical College and the house of the principal of the hospital?
SG: 15 to 20 minutes
CJI: At what time was the case of unnatural death registered?
SG: Please see the chart. After all she is the daughter of all of us.
Sibal: The death certificate was given at 1:47 pm. The entry of unnatural death was made at the police station at 2:55 pm.
CJI: Is unnatural death number 861?
Sibal: Yes
CJI: When was the crime scene investigated and evidence collected?
Sibal: From 8:30 a.m. to 10:45 a.m. This was after the body was taken for postmortem.
SG: But who did this? This is also a matter worth keeping in mind.
CJI: See, the CCTV footage clearly shows when the accused entered the seminar room and when he came out. After that, there will be footage after 4:30 pm. Was that footage given to CBI?
SG: Yes, we got all the recordings. We had to recreate the scene.
CJI: Has Kolkata Police submitted the entire footage from 8:30 am to 10:45 pm?
Sibal: Yes
CJI: But CBI is saying that only 27 minutes of video has been shared.
Sibal: The evidence collected between 8:30 and 10:45. Some parts of its video have been provided. There was some technical glitch. The hard disk was full, which has been provided in full.
SG: We have the forensic investigation report. When the body of the trainee doctor was found, she was half naked. She was not wearing jeans and undergarments. There were injury marks on her body. Her samples were taken. The government got the investigation done at CFSL in Bengal. While the CBI has decided to send the samples to AIIMS and outside forensic labs.
SG: The time of the report is not mentioned in the postmortem report.
Sibal: Everything is present.
SG: Who did the videography? There are no details.
Sibal: The Judicial Magistrate was there.
SG: The wounds on the girl’s private parts indicate that she was raped. And the cause of death was strangulation by hand.
SG: Another mystery is that there are only 10 entries in the general diary between 2:30 pm and 11:30 pm. Are these written by themselves?
CJI: Yes, the entries at 5:42; 5:65; 5:76 and 6:81 raise suspicion. The CBI knows this and is investigating.
CJI: When the body is sent for postmortem after investigation, a challan is sent, without it the doctor conducting the postmortem does not take the body.
CJI: Where are the invoices? We want to see it.
Sibal: Please give us time. We will present it in the court. As far as I know the challan was filled and sent by the CJM himself.
CJI: This means, was the postmortem done without sending the challan?
SG: This cannot happen. This is a legal process.
Justice Pardiwala: The third column in the post-mortem report has the name of the constable who carried the form. There is no mention of the challan. If this document is missing then something is wrong.
Another lawyer: I have the names of the goons who broke into the hospital and tampered with the evidence.
Sibal: The CBI itself has not said that the seal has been broken.
Geeta Luthra: This is a complete mess.
Luthra: Firstly, people are being allowed inside the hospital without checking their identity cards.
Luthra: Another request is that the pictures of trainee doctors are being made viral on social media, this should not happen
CJI: We order the removal of all photographs.
CJI: We hope that the West Bengal government thinks about creating a safe place for doctors to work without waiting for the task force report.
Sibal: Please see the report of the health department. Some guidelines have been issued. CCTV surveillance is also being done.
CJI: Well, as is being said that 3,700 CCTVs were already working. Then why did this crime happen? The government should tell us what the state government has done regarding security at RG Kar Hospital after the matter came to the court?
Second issue- on doctor’s safety and joining duty
Sibal: 23 people lost their lives due to doctors going on strike. 6 lakh people did not get treatment. Resident doctors are not coming to OPD. Angiography of more than 1500 patients was not done. Doctors were asked to go back to work. Now it should be noted that action will be taken against them if they do not come to work.
CJI: Who is appearing on behalf of the Doctors Association?
Senior Advocate Nandi: We have come here. There are two groups of doctors. Advocate Luthra is also from the doctor’s side.
CJI: Are all doctors on duty?
Advocate Luthra: Medical doctors and junior doctors of West Bengal are not on duty. There are 1700 hospitals, doctors are on duty in 1500 but junior doctors are not on duty in Calcutta. They are still getting threats.
CJI: We will give a direction that if the doctors do not return to work, we cannot stop the state government from taking disciplinary action against them. If they return to work, no action will be taken against them as we are aware of the matter.
Advocate Luthra: But doctors are receiving threats. Many of these doctors supported the protests and are therefore facing threats.
CJI: It would be better if you go back to the hospitals where you should work.
CJI: If the doctor reports for duty on or before 5 pm tomorrow, no disciplinary action will be taken against him. However, if the doctor continues to stay away from work, disciplinary action can be taken against him.
