In a significant order linked to the 2022 Chintels Paradiso collapse on Dwarka-Gurgaon Expressway, the Haryana Real Estate Regulatory Authority (HRERA) has directed the developer to pay over Rs 4 crore as compensation to a homebuyer, relying in part on Google’s AI-powered insights to assess rising property prices.

According to a report in Indian Expressin a first-of-its-kind move, the adjudicating officer referred to Google’s ‘AI overview’ to determine how much property rates have increased in Gurugram’s Sector 109.

The authority reportedly noted that prices rose from around Rs 6,500-7,000 per sq ft in early 2022 to nearly Rs 12,000-12,400 per sq ft by early 2026, a jump of about 64.7%.

Based on this, compensation was fixed at Rs 13,000 per sq ft, far above the Rs 7,500 per sq ft earlier offered by the developer.

2022 Collapse That Rendered Entire Project Unsafe

The case stems from the February 10, 2022 collapse in Tower D of Chintels Paradiso, where multiple floors gave way, killing two residents.

Investigations by IIT-Delhi and the Central Building Research Institute found serious structural flaws, including poor-quality concrete. Eventually, all nine towers in the project were declared unsafe, with demolition carried out in phases.

Developer Liable for ‘Uninhabitable’ Project

HRERA held the builder fully responsible, underlining that homebuyers were promised high construction standards. The authority reportedly said the defect lay entirely with the developer, and buyers could not be penalised for structural failures that made the project unfit for living.

Compensation vs Reconstruction: No Consensus

While the Supreme Court had earlier given two options — compensation or reconstruction — the builder refused to rebuild the project.

The complainant, on the other hand, rejected the lower compensation benchmark, arguing it failed to reflect current market rates. She also cited higher prices in nearby projects by the same developer.

Final Compensation Package

The authority has ordered a payout of over Rs 4.09 crore, including the cost of the flat. It also includes reimbursement of stamp duty, damages for mental agony, and litigation costs.
