- Supreme Court Said That The Judge Will Not Be Punished For A Wrong Decision

The Supreme Court on Monday canceled the dismissal of Madhya Pradesh judicial officer Nirbhay Singh Sulia.
Making an important comment, the court said – Disciplinary action cannot be taken against a judicial officer merely on the basis of passing a wrong or erroneous judicial order. Actually Sulia was removed from service in the year 2014. Then he was working on the post of Additional District and Sessions Judge, Khargone.
Sulia was accused of adopting double standards on bail petitions in cases related to corruption and Excise Act. It was said that in some cases involving seizure of more than 50 bulk liters of liquor, he granted bail, while in other such cases he rejected bail on the same grounds. After departmental inquiry, the High Court dismissed him.
Now the bench of Justice JB Pardiwala and Justice KV Vishwanathan ordered that the judge who had given impeccable service for 27 years was removed without following due process, which is not fair.
Court said- Judgment error and corruption cannot be considered as one.
- Advice to avoid action without thinkingThe Supreme Court said that the High Court should be extremely cautious in taking departmental action against judicial officers. Mechanical action merely on wrong order or error of judgment weakens judicial independence and discretion.
- Administrative scare and increase in bail applicationsThe Supreme Court said that due to fear of administrative action, lower courts avoid granting bail in many deserving cases. Due to this, bail petitions reach higher courts. The High Court, understanding the stressful working conditions of the District Judges, should not take action without solid basis.
- Strictness on false complaintsThe bench expressed concern over false and baseless complaints against judicial officers. The court said that strict action should be taken against such complainants. If the complainant is a lawyer, the matter should be referred to the Bar Council.
- clear message on corruptionThe Supreme Court clarified that this decision does not protect corruption. If misconduct is prima facie proved against a judicial officer, disciplinary action should be taken immediately, as corruption in the judiciary is intolerable.
