CBI Objected, Victim Warned Of Threat Yet Kuldeep Sengar Got Interim Bail Four Times

From his daughter’s wedding to treatment at AIIMS, Sengar received 23 days of interim bail across four occasions despite consistent resistance from the victim and investigators.

For the marriage of his daughter, for his own cataract surgery, and for attending to issues such as anxiety and diabetes, Kuldeep Singh Sengar stepped out of jail four times in the last three years on interim bail. Sengar relied on this to tell the Delhi High Court that he was no threat to the victim’s family, as he had not misused his liberty earlier while on bail.

CNN-News18 studied the Delhi High Court orders regarding those four instances and found that Sengar received interim bail despite strong objections from the rape victim as well as the CBI.

Sengar received the benefit of suspension of sentence on four previous occasions for a total of 23 days — from 27 January 2023 to 1 February 2023; from 6 February 2023 to 10 February 2023; from 11 December 2024 to 20 December 2024; and from 23 December 2024 to 24 December 2024.

The Delhi High Court suspended Sengar’s sentence permanently on 23 December 2025, saying it could not keep him in custody merely because of apprehensions that the police or paramilitary forces may not properly safeguard the rape victim. The court also said that keeping Sengar in custody on grounds of threat perception to the victim was “not a tenable argument”.

In response to the argument on threat perception, Sengar, during his submissions before the Delhi High Court, placed strong emphasis on the fact that he had been granted suspension of sentence on four earlier occasions.

What Happened Earlier

The first time Sengar received interim bail from the High Court was on 27 January 2023, for his daughter’s wedding. He was granted interim bail for 15 days — until 10 February 2023. Sengar told the court that the wedding rituals and ceremonies would be held in Gorakhpur and Lucknow and that, being the only male family member, he needed to make multiple arrangements.

The victim and the CBI objected strongly. The victim said she might be killed while Sengar was out. This led the High Court to revise its order and direct Sengar to surrender before jail authorities on 1 February, as the tilak ceremony was on 30 January. Sengar was then released again from jail on 6 February and surrendered on 10 February, with the wedding taking place on 8 February.

This seemed to have raised Sengar’s hopes. A year later, he approached the High Court again seeking an interim suspension of sentence for a much longer period of five months, citing multiple medical ailments. Sengar submitted a medical report listing eight conditions, including diabetes, hypertension, bronchial asthma, age-related degenerative spine disease, cataract-related eye issues, internal haemorrhoids, bilateral hydrocele, and anxiety.

The court found Sengar’s request for five months to be excessive, but he received interim bail from 11 December 2024 to 20 December 2024. He was admitted to AIIMS, New Delhi, where a medical board comprising eleven doctors from various departments examined and treated him. The board noted that his diabetes and hypertension were controlled with oral medication, his asthma was managed with inhalers, and his spine-related issues required only exercise, physiotherapy, and medication. He underwent laser treatment for eye-related issues on 13 December 2024 and a banding procedure for haemorrhoids on 16 December 2024, according to High Court documents.

After reviewing his condition, the medical board concluded that Sengar was stable and fit for discharge. The report stated clearly that all necessary interventions had been carried out at AIIMS and that his condition could now be managed on an outpatient basis at a local medical facility. AIIMS said prolonged hospitalisation was not required in Sengar’s case.

However, during his stay at AIIMS, the hospital raised serious concerns. In a written communication dated 13 December 2024, the Member Secretary of the Medical Board flagged the unusually large number of visitors meeting Sengar during his admission. AIIMS stated that the high volume of visitors was compromising medical care and adversely affecting routine hospital functioning. This communication was sent to the Director of the CBI, requesting appropriate security arrangements.

Sengar received another interim bail for two days on 23–24 December 2024 to undergo cataract surgery at AIIMS, Delhi.
