सुप्रीम कोर्ट बोला- UCC लागू करने का समय आ गया: संसद फैसला करे, शरियत कानून की धाराएं रद्द करने से कानूनी खालीपन पैदा हो सकता है

The Supreme Court on Tuesday said that the time has come to implement Uniform Civil Code (UCC) in the country. The court was hearing a petition demanding repeal of some sections of Shariat Act 1937 alleging discrimination against Muslim women. The three-judge bench comprising CJI Surya Kant, Justice Joymalya Bagchi and Justice R Mahadevan said that the issue of discrimination in the petition is serious, but it is the job of Parliament rather than the court to decide on it. During the hearing, the court said that if the sections of Shariat law were canceled then there would be no clear law left regarding distribution of property in the Muslim community. This could create a legal vacuum. CJI Surya Kant said that in the hurry of reforms, it should not happen that the people whose rights are being talked about get harmed. The court has said many times about the implementation of Shariat Law 1937. This law applies Islamic personal law in matters like marriage, divorce and division of property in the Muslim community. In India, UCC is applicable only in Uttarakhand. In India, UCC is currently applicable only in Uttarakhand. UCC was implemented there on 28 January 2025.
