After being acquitted by the trial court on February 27, Kejriwal reached his home and hugged his wife and started crying.
Former Delhi Chief Minister and Aam Aadmi Party (AAP) convenor Arvind Kejriwal will present his arguments in the Delhi High Court in the liquor scam case on Monday.
This case is related to the petition of CBI, in which the trial court’s order granting relief to Kejriwal, Manish Sisodia and other accused has been challenged.
On Sunday, Kejriwal and 22 other former accused filed an application demanding recuse of Justice Swarn Kanta Sharma, who is hearing the case.
Recuse means that a judge recuses himself from hearing a case if there is a potential conflict of interest, bias or impartiality.
The trial court had acquitted 23 accused including Kejriwal.
On February 27, the trial court had given relief to all the 23 accused including Kejriwal in this case. The trial court had also strongly criticized the CBI investigation in this case.
Justice Swarn Kanta Sharma had heard the CBI’s petition against the trial court order and on March 9 had said that prima facie (at first sight) the observations of the trial court appear to be wrong.
After this, Kejriwal wrote a letter to High Court Chief Justice Devendra Kumar Upadhyay demanding change of the judge and said that no clear reason was recorded for commenting against the order of the trial court.
He also said that Justice Sharma had earlier refused to grant bail to many accused in this case, while later the Supreme Court gave them relief.
The AAP leader said that he suspects that the case will not be heard in a fair and neutral manner. Therefore the case should be transferred to another bench.
Kejriwal has also filed a separate Special Leave Petition (SLP) in the Supreme Court challenging Justice Sharma’s comments.
The Delhi government had made an excise policy in 2021 to increase revenue and improve the liquor trade, which was later withdrawn after allegations of irregularities.
After this, Lieutenant Governor Vinay Saxena ordered a CBI investigation. CBI and Enforcement Directorate (ED) allege that private companies were benefited through this policy and corruption took place in it.
Sisodia was arrested by CBI on 26 February 2023 and later on 9 March 2023, ED also arrested him. The FIR alleges that he and others took decisions in the Excise Policy 2021-22 without the approval of the competent authority and acted with the intention of benefiting the licensees.
CBI also claims that Sisodia was arrested because he did not cooperate in the interrogation and gave evasive answers despite the evidence.
Whereas Kejriwal was arrested and sent to custody during the 2024 Lok Sabha elections. He got bail from the Supreme Court after 156 days of custody. Sisodia remained in jail for 530 days in this case.
