Leader of Opposition Umang Singhar has filed a petition in the High Court to cancel the assembly membership of Nirmala Sapre.
Hearing was held on Tuesday on the petition filed in the High Court against Nirmala Sapre, MLA from Bina seat of Sagar district. During this Sapre said- I am still in Congress. The court has taken this statement on record. Petitioner leader of opposition Umang Singhar was shot with sapre.

To this Singhar has replied that he will present copies of the party whip by April 9. The next hearing of the case will be on April 20. A hearing is also scheduled before the Assembly Speaker on the same day.
Actually, in 2023, Nirmala Sapre had won the assembly elections from Bina seat on Congress ticket. On May 5, 2024, during the Lok Sabha election campaign, she had attended BJP’s program with CM Mohan Yadav. After this, claims were made about his joining BJP.
On July 5, 2024, Leader of Opposition Umang Singhar petitioned the Speaker to terminate Sapre’s assembly membership. It said that under the 10th Schedule of the Constitution, the membership of an MLA automatically ends when he changes party. When no decision was taken on this, Singhar filed a petition in the High Court in November 2024.
MLA Sapre had reached the stage at the program of CM Dr. Mohan Yadav in Rahatgarh on 5 May 2024 during the Lok Sabha election campaign. Since then he is with BJP while keeping distance from Congress.
Evidence of Sapre joining BJP on social media
The hearing was held on Tuesday by the Division Bench of Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf. In this, Nirmala Sapre’s lawyer Sanjay Aggarwal claimed that she was in Congress only. Said that in such a situation the question of terminating Sapre’s assembly membership does not arise.
At the same time, on behalf of the government, Advocate General Prashant Singh told the court that the hearing of the case is going on before the Speaker. Their statements have also been recorded.
After this, Umang Singhar’s advocate Vibhor Khandelwal said through video conferencing that he will present copies of the party whip by April 9. Evidence of Sapre joining BJP is available on social media. Many of her pictures and posts with CM Mohan Yadav are also viral.
Situation cannot be decided on the basis of social media
On the argument given by Singhar, the court said – the status of the person concerned cannot be decided on the basis of the post made on social media. The petitioner should present concrete and authentic evidence before the Speaker to prove that Nirmala Sapre has indeed defected.
