Women employees in Delhi will now be able to work in night shifts in shops and other commercial establishments. The Delhi government has issued a notification on Thursday giving its formal permission. However, for this, written consent of the women employees will be mandatory.

The notification states that every employee will get double the normal salary on overtime and the maximum limit of weekly work has been fixed at 48 hours. Along with this, it has also been made mandatory to form Internal Complaints Committee (ICC) in all establishments.

The proposal to allow women to work in night shifts was approved earlier this year by Lieutenant Governor V.K. Saxena had approved. After this, the Labor Department has added two new provisions in the Delhi Shopkeepers and Commercial Establishments Act, 1954, which are related to the appointment of women and their working conditions.

Those responsible will have to take care of these things

  • Women employees can be employed in night shift only if they agree to it in writing.
  • No employee will be able to work more than 9 hours in any day (including meal breaks) and more than 48 hours in a week.
  • Work will not be allowed for more than 5 hours continuously.
  • The employer will have to make arrangements for security, transportation and appropriate facilities for employees working night shifts or overtime.
  • Overtime will be paid at double the pay rate.
  • The shift system will be made in such a way that no employee is forced to work only in night shift.

Provision for security and surveillance also The notification states that in every establishment where women are employed, an Internal Complaint Committee (ICC) will be constituted under the Prevention of Sexual Harassment Act, 2013.

Also, CCTVs will be installed in all such work places and their footage will be saved for at least one month. If needed, this recording will have to be presented to the Chief Inspector (Shops Department).
