Allahabad High Court has once again sought answers from the UP government on the issue of place of worship and mosque. The High Court has asked the Uttar Pradesh government whether it can seal any place of worship and mosque without any prior notice or giving the property owners an opportunity of being heard. Allahabad High Court issued the order after the hearing on March 18. A division bench of the High Court comprising Justice Atul Sridharan and Justice Siddharth Nandan also asked the state government to clarify under what legal authority it can seal a place of worship. The court asked the state, “Is there any legal right to seal a place of worship under construction without issuing prior notice or giving an opportunity of being heard to the petitioner?” Also, the High Court has also asked whether any prior permission is required from the owners in case of construction etc. within the premises of the place of worship. Order on the petition of Ahsan Ali The case is related to Muzaffarnagar. Ahsan Ali has filed a petition in Allahabad against the sealing of a mosque in the district. Hearing the matter, the High Court said that he was the legal owner of a plot of land in Muzaffarnagar, through a duly registered sale deed, because the owners had started building a boundary around it. And no prior permission was obtained from the competent authority. Advocate Jagdish Mishra said that no notice or opportunity of hearing was given to him before sealing the premises. The court ordered that specific instructions along with the affidavit be obtained before this court on the next date of hearing. Following the roster change in the court, the case was listed before a bench of Justice Saral Srivastava and Justice Garima Prasad on March 24. However, the case could not be heard that day.
