Delhi High Court said – SC-ST Act will not be imposed just because of misbehavior, case against DU professor canceled

Delhi High Court has given an important decision saying that Scheduled Castes and Tribes (SC-ST) Prevention of Atrocities Act cannot be implemented only on the basis of abuse or dispute.
While quashing the FIR lodged against a female professor of Delhi University, the court made it clear that an offense under this law is made out only when a clear intention to insult on the basis of caste is proved.
In August 2021, there was a dispute between two associate professors of Lakshmibai College over the signing of a document in a departmental meeting, which reached an alleged scuffle. After this the complainant registered a case under the SC-ST Act.
The court found that the initial complaint did not mention casteist remarks and the allegations added later were also not clear. On this basis the High Court canceled the FIR.
