H1B visa as a scam by Florida Governor Ron Desantis
After the tariff, now the US is also showing strictness on work visas, student visas and green cards. The government has prepared to introduce new rules, under which visa duration of foreign students, people coming to cultural programs and foreign journalists will be reduced.
Till now these people were allowed to stay in America according to the need. But according to the new rule, foreign students and cultural guests will get a visa of up to 4 years. Foreign journalists will get 240 days visa.
The Trump administration says that this will make the monitoring of visa holders easier and will prevent misuse. But this decision may have a direct impact on Indian IT companies and Indians studying and working in America.
Meanwhile, US Commerce Minister Howard Lutynik and Florida Governor Ron Dysentis described the H-1B visa as a ‘scam’. Dysentis say that the people of India are getting the most benefit of this visa.
Around 75% of Indians get the H-1B visa released in the US. India prepares millions of engineering and computer science graduates every year, which plays a big role in America’s tech industry.
Companies like Infosys, TCS, Wipro, Cognizant and HCL are most H-1B visa sponsors. That is why it is said that India exports more people than goods to America, ie engineer, koder and student.
The Trump administration is also strict about the students (F visa) and exchange visa (J visa). The rule already was that as long as the student’s admission remains, he would be allowed to live. But now the new rule is that students and exchange visas will be valid for only 4 years. The duration of foreign journalists (i visa) will be fixed at 240 days, which can be extended later.
The rule in the US since 1978 has been the rules that students and exchange visas used to get entry on the basis of ‘Duration of Status’. That is, if a student’s admission is going on, then he used to get permission to stay in America without repeated immigration checks. With this, they could stop their studies or exchange programs till the end.
But the Trump administration says that this system is producing ‘permanent students’. Therefore, the validity of F and J visa in the new rules will be limited to maximum 4 years. If a student or exchange program is longer than this, he will have to apply separately for visa extensions.
Indian students go to America in large numbers of master and PhD. After studies, they enter H-1B through OPT program. The Trump administration is also trying to limit this route.
Ron Desantis alleged that many companies are removing American employees and keeping H-1B employees. He said that earlier it was claimed that H-1B brings the best talent in the world, but in reality it is not so.
Desantis said that this program is harming young Americans who are already facing job crisis with technologies like Artificial Intelligence.
Minister Howard Lutnik said that the current H-1B system is actually a scam, which is filling American jobs with foreign workers. He claimed that both the green card and the H-1B system would be replaced so that the US would only attract top talent.
Lutnik said the average American salary is $ 75,000, while the average green card user earns $ 66,000. That is, America is suffering losses. According to Lutnik, Trump will change this system and bring ‘gold card’.
This card will give permanent residence to foreigners who will invest 5 million dollars in the US. He says that so far 2.5 lakh people have shown interest in the scheme and it can bring a revenue of $ 1.25 trillion.
Donald Trump’s attitude towards the H-1B visa has always been confused. He sometimes supports it and sometimes opposed it. In January 2025, Trump clearly stated that he supports the H-1B visa program.
On the one hand, they believe that America should allow extremely capable people to come here, so that they can also train Americans who are not as capable. Trump said that it should not be limited to engineers, but people of all levels should be included. But the problem is that Trump’s stance depends on their mood and often changes.
On the other hand, they also say that this program is being misused and it is putting an economic burden on American employees. He described it as a system that keeps companies keep cheap foreign employees and take away the jobs of American workers.
